MyMilk Laboratories LTD., or its affiliate, operates the MyLee application and the following websites  Hereinafter: ("Mylee.life" and "MyMilklab.com") and offers, through it a variety of services and content Including, but not limited to, the ordering of MyLee milk sensing device, MyLee mobile Application or  web Apps, presentation of information or results after analysis, presentation of personalized information regarding breastfeeding and nutrition, general information presented in the site in various fields related to the Company's fields of activity, text, graphics, images, Computer and any other information and material), as updated from time to time (the " Services ").
The company provides the MyLee system, a non-medical device and App that enables lactating mothers to obtain personal non-medical information about their milk properties, to strengthen their confidence in their natural feeding capacities and to optimize management based on their personal data. The Mylee SYSTEM is a new development by MyMIlk Laboratories LTD, intended for early feedback on breastfeeding and milk dynamics changes. Mylee system includes MyLee milk sensing device for sensing a tiny sample of breast milk and mobile app for recording some personal information, a and for generating personalised non-medical insights. The company's vision is to improve breastfeeding success and experience using science-based means for the benefit of the infant and mother. Collectively, the Website, the MyLee Device, the MyLee App and the MyLee Services, shall together be referred to hereunder as the “Services”). You may use the Services solely in accordance with the terms and conditions hereunder. 

Use of the Site and the Services is subject to the terms set forth in the Terms of Use below, the Privacy Policy and the waiver and consent letter (collectively, the " Terms of Use "). These terms of use are formulated in the feminine language, but as relevant they relate to both men and women. 

2. Acceptance of Terms of Use

In order to use the Site, App and the Services, you must first agree to these Terms of Service. You may accept the terms of use by (1) clicking to accept or agree to the Terms of Service in the manner available to you on the Site or MyLee mobile App (e.g. when registering for a site or mobile App or purchasing a product) or (2) simply by using the Site, mobile App or the Services provided by MyMilk. In this case, you confirm and agree that the Company will treat your use of the Site, mobile App or Services as acceptance of the Terms of Use from that point forward. If you do not wish to use the Site or mobile App or benefit from the services it provides, you must terminate the use immediately and if you already started a use  then ask to close the account according to the instructions specified or by an email request to contact@mymilklab.com .
Your use of the Site, the Mylee system, the MyLee mobile App or the Services of the Company (except services provided by the Company under a separate agreement signed between you and the Company), in whole or in part, whether you are a registered user or not, is subject to these terms of use which constitute a legally binding agreement between you and the Company. Some of the content on the site may be used even without registration, but without registration, much of the information will not be available or accessible to you.
Except as otherwise expressly stated in these Terms of Use, the Terms of Use will apply to any use of the Site and the Services, including but not limited to, interaction with the Site, registration of the Site and to Mylee App, use of the Application for content, recording data and milk sensing, home milk self sampling and scanning that will be done according to the instructions contained in the product box (incorporated into these terms of use and constituting part of it by reference), analysing your milk data, and without or with other information recorded in the App, and receiving the results on the App or by any Other means.
In addition, when using the Site and certain services, you are subjected to all the guidelines and rules applicable to these services as published from time to time. All of these guidelines or rules (found in the following links: instructions for use) are hereby incorporated by reference into these Terms of Use and constitute part thereof. The Company may offer additional services from time to time that will be subject to various conditions of use of these Terms of Use, as expressly stated in these cases.

Researcher / Professional Partner Terms. If you use the MyLee system in connection with academic research, institutional studies, evaluation projects, or professional field use (including by clinicians or care providers and including where access requires a permission/authorization code), your use is also subject to the Researcher & Professional Partner Terms of Use, which are incorporated by reference and prevail in case of conflict for such use.

MYMILK SERVICES, AND SPECIFICALLY MYLEE DEVICE AND APP ARE INTENDED FOR USE BY HEALTHY INDIVIDUALS OVER 18, AND CANNOT AND IS NOT INTENDED TO DIAGNOSE OR TREAT ANY MEDICAL OR HEALTH CONDITION IN THE MOTHER OR THE BABY OR FOR PREVENTING ANY DISEASE. SERVICES ARE NOT A MEDICAL PRODUCT BUT RATHER A WELLNESS PRODUCT. THE SERVICES DOES NOT PROVIDE ANY PROFESSIONAL MEDICAL ADVICE OR DIAGNOSIS. ALWAYS CONSULT A PROFESSIONAL HEALTH PROVIDER ABOUT YOUR HEALTH. IF YOU DO NOT MEET THESE REQUIREMENTS OR IF YOU SUFFER FROM ANY MEDICAL CONDITION, YOU SHOULD CONSULT WITH YOUR PROFESSIONAL HEALTHCARE PROVIDER PRIOR TO USE OF THE SERVICES. RELIANCE ON THE INFORMATION AND RECOMMENDATION PROVIDED IN THE SERVICES IS SOLELY ON YOUR OWN RISK AND YOU ARE THE SOLE RESPONSIBLE FOR ANY ACTION YOU TAKE BASED ON SUCH INFORMATION.  

3. early conditions

1. Whether you are ordering a product for yourself or a product  on behalf of someone for whom you have legal authority to order a product for, you must not use the Site or Services and you must not accept these Terms of Service if (A) you are under the age of 18 or (b) you are prohibited from receiving the Services in accordance with applicable laws in the country / state in which you live or from which you use the Services.

2. If your use of the Site, mobile App and Services is to create an account on the Site or to interact with the Site only, without having to order a product from the Website, you must be over 18 years old and accept the Terms of Service.

1. Description of services

The services include access to the MyMilk website (www.mymilklab.com ; www.mylee.life), interaction with the site, which enables you to browse the content on the site in various fields related to MyMilk's fields of activity and the services it provides, the ability to respond and upload various types of content to the site. The users who choose to order and interact with The MyLee product, may register for the site or Mylee mobile Application, and receive a MyLee device for scanning a sample of the breast milk, and an access to mobile Application, for milk result visualisation, recording maternal data, and receiving system-generated information. The user who chooses to record personal information in addition to the milk scans enables the App to receive nursing recommendations according to the answers to the questionnaire and the milk results. 

Detailed instructions of use are provided in the product box, including instruction of  milk sample collection, scanning, recording, and washing. System is not intended for direct touch with the mother's breast, and Milk is dismissed after scan. The use of the Mylee scanner is at user own risk and in the user’s sole discretion. The Mylee product is intended only for breastmilk and not any other liquid. Non-adherence to the user instructions of scanning and the maintenance of the scanner, provided in the user guide  may significantly impair the reliability of the results and are solely the user’s responsibility. The User must agree to these Terms, as well as review the user guide and related MyLee Device documentation prior to using the MyLee to ensure proper usage.

You hereby consent for the processing and presentation of any  protected health information you provide or generate via the mobile App as described herein. It is hereby clarified that the information will be displayed on your mobile and will include the results of personal information, and other health related data or information (such as  breastfeeding management recommendations). It is hereby clarified that the information is intended for your personal and private use and concerns you and your baby. You agree and warrant that the protected health information about you will be displayed in your account on your mobile and the Internet. It is hereby clarified to you that the access to the health information is through a personal username and password. 

MyMilk will take all the usual measures to secure the information, but you know that the Internet is not completely blocked from hacking and the user agrees to disclose the protected health information on the Internet despite the risk involved.
The user declares that she is aware of the fact that the health information is sensitive information protected by law and that the transmission of information via the Internet is based on the user's personal code and password, in secure and encrypted communication.
Unless specifically stated otherwise, any new service offered on the Site or App and any new features that improve the current Service will be subject to these Terms of Service. You declare and agree that the Company may temporarily or permanently discontinue the provision of certain services, in whole or in part, to you or to all Users, at the sole discretion of the Company, without notice. In addition, the Company may restrict or block access to the Website or the mobile Application, in a hole or to specific features, to you or to all Users, at any time, for any reason and without reason, at its sole discretion.
You may discontinue use of the Services at any time without prior notice unless you request to deleteyour account and in such case you must send notice to the Company and the Company will close the Account within a reasonable time. 

4. Account creation, account sign-in, and security obligations.

Most of the content displayed in the Mylee mobile Application is personalized content for which registration is required. If you are interested in receiving personalized services and content, you must register for MyMilk services and to create a personal account. In the purchase or registration process, you agree to provide a personal identifier information so that we can provide you with the services properly: (1) name and surname, (2) full residential address, (3) email address, (6) the date of baby’s birth, (7) the date of birth of the mother, (8) selecting a unique user name and password (" user information "). You warrant that the details of the user you provide are correct and accurate. If the user information you provided is incorrect or inaccurate, or if the company has reasonable grounds to suspect that the information is inaccurate , the company has the right to freeze or terminate your account and refuse to provide you with services, in whole or in part, now or in the future. 

To receive certain services, such as personalized recommendations, you are asked to answer various questionnaires about your breastfeeding practices, baby weights, baby behaviour, and your pregnancy and birth related information. This information is considered to be part of the user details. It is not obligatoryto fill in these questionnaires and you may choose not to provide these data while using the MyLee App. You acknowledge that failure to complete a questionnaire or partial filling will impair the computerized recommendations. You acknowledge and agree that these tools are intended to provide a general estimate only in accordance with the data you entered. 

You are responsible for maintaining the confidentiality of your password and login credentials. You are fully responsible for any activity performed under your username and password. If you have enabled third parties to access your account, you will indemnify and defend the Company against any cost or demand, including attorneys' costs, arising out of a third party claim based on such access and use. You agree to immediately notify the Company of any unauthorized use of your account or any other security breach. And you are responsible for leaving your account at the end of your activities. The Company can not and shall not be liable for any damage or cost resulting from failure to comply with these terms. 

5. Site order execution policy

Upon completion of the registration process, you can purchase a MyLee product.. After you place your order on the website, you will receive an initial email to the address you provided for receiving your order details. Please note: this certification does not require the company to provide the services you have ordered, and it only indicates that the order details have been entered into the system. Only after the Company or anyone on its behalf has completed checking your credit card or payment instrument information and you receive the credit card company's authorization to make the purchase will your offer be considered executable. You will be charged with the credit card whose details you provided at the price that appears next to the products you ordered, plus the shipping costs when applicable, all as detailed in the cart of products at the time of the purchase.
MyMilk may change the prices of the Services and the handling and shipping fees from time to time. The valid price in relation to your order is the price to be posted on the site when the order process is completed. The prices shown on the site may include some taxes as per the law.
In order for us to supply you with the products you have ordered, your order must be received and received in a proper and orderly manner, containing all the details required for the shipment and billing of the products.
If incorrect identification information is provided at the time of booking, we can not guarantee that the products will reach you. In the event that the products come back to us due to erroneous details that you provided, your account will be charged a recurring fee for shipping and handling fees. Please make sure to fill out accurate and up-to-date information. 

6. Payments. 

Any payment terms presented to you in the applicable purchase process are deemed part of these Terms of Use and incorporated herein by reference. You may pay the Fees by credit card or one of the other options made available to you through our Website. Payments are processed by one of our third-party payment clearance service providers such as PayPal, PayPlus, Stripe, withFlex (for FSA/HSA clearance) etc. (the “Payment Services”) that are integrated and embedded on the Website. If you proceed with a purchase on our Website, then you: (i) agree to review and be bound by the relevant Payment Services' terms of use and privacy policy; (ii) acknowledge that you may need to hold, or register, an active account at such Payment Services in order to complete a purchase and (iii) acknowledge that confirmation or rejection of your payment is not performed by MyMilk. We are not responsible or liable for any activities or conduct of any Payment Services, and you agree to hold us harmless, and expressly release us, from any and all liability arising from or in connection with any payment activity performed on our Website.

7. Intellectual rights and limited license

The Company hereby grants you a limited, personal, non-exclusive, terminable, non-transferrable, non-assignable, non-sublicensable, time limited, license to use the Services, subject to these Terms. Except for the limited right to access and use the Services as permitted hereunder, and except for ownership of the hardware component of the MyLee Device by its purchaser, these Terms do not entitle you to any right in and/or to any of the Services, including without limitation the App, the MyLee Device, and/or the Website.

All references in these Terms to the purchase or sale of the MyLee App, Mylee Devices or of Services or any part thereof, shall include the sale, lease, licensing, rental, subscription or other transfer, conveyance or disposal of any product (including, for the removal of doubt, any related service; however the parties intend and agree that as the MyLee App, the MyLee Devices and/or Services include software (including, without limitation, any firmware) such software is not being sold, but shall only be licensed in accordance with the terms and conditions of these Terms.

MyMilk and MyLee’s marks and logo (whether or not registered) and all other proprietary identifiers used by MyMilk in connection with the Services (the “MyMilk Trademarks”) are all trademarks and/or trade names of MyMilk Laboratories, whether they are registered or not. All other trademarks, trade names, identifying marks and logos appearing in the Services belong to their rightful owners (“Third Party Trademarks”).

No right, license, or interest to MyMilk Trademarks or Third Party Trademarks is granted hereunder, and you agree that no such right, license, or interest shall be asserted by you with respect to MyMilk’s Trademarks and therefore you will avoid using any of those marks unless such use was specifically authorized in the Terms.

Our Services, the Content and any and all intellectual property rights pertaining thereto, including, but not limited to, inventions, patents and patent applications, trademarks, trade names, logos, copyrightable materials, graphics, text, images, designs (including the "look and feel" of our Services), specifications, methods, procedures, information, know-how, algorithms, data, technical data, interactive features, source and object code, files, interface and trade secrets, whether or not registered or capable of being registered and all enhancements, modifications and derivatives thereof (collectively, “Intellectual Property”), are owned and/or licensed to MyMilk and subject to copyright and other applicable intellectual property rights under your local laws, Israeli laws, foreign laws and international conventions. You are hereby prohibited from removing or deleting any and all copyright notices, restrictions and signs indicating proprietary rights of MyMilk or its licensors, including [®], copyright mark [©] or trademark [™] contained in or accompanying the Content included on the Website, and you represent and warrant that you will abide by all applicable laws in this respect.

8. Prohibitions

For breastmilk sensing, breast milk should be scanned without any intervention. Any liquid other than breast milk (collected in accordance with the user guide instructions), including milk from a non-human source and / or milk compounds, may not be used. 

A condition for your use of the Site and the Services is that the use will be done in good faith and in accordance with the provisions of these Terms of Use. You undertake not to use the Site and the Services for any purpose that is illegal or prohibited by law or regulation that is relevant or prohibited by these Terms of Service or is prohibited by notices appearing on the Site or by instructions and other materials distributed with the Services. 

You undertake not to make use of the Site or the Services in any manner that may harm, paralyze or burden the Services. You undertake not to misuse this Site and not to take actions that may harm the Company or other users through the Site or the Services. You may not attempt to access or obtain material or information in ways that are not directly and clearly accessible on the Site or through the Services. 

Without derogating from the foregoing, you warrant that you will not cause or contribute, either by conduct, by act or omission (directly or indirectly) to any damage to the Company or to third parties and that by using the Site and the Services you will not violate any right of the Company or such third party, copyrights, moral rights, proprietary rights, trust obligations, data confidentiality, trade secrets, trademarks, patents, libel, infringement of privacy, and the publication of prohibited publications by law . 

The right to make use of the information on the Site or mobile App and which is provided through the Services is for your personal and private use only. No commercial use of any information or profit is permitted, and you may not allow any use of such information to any third parties, whether for consideration or for no consideration. It is hereby clarified that no information published on the Website or mobile App may be used for the purpose of displaying it on the Internet or any other service, without receiving the Company's consent in writing and in advance and subject to the terms of such agreement, if and when provided. 

You warrant that you will not collect information by means of various types of software or distribute information published on the site in public, commercially, or for any other purpose. The site or mobile App should not be presented in a different graphic design or interface than those prescribed by the company, subject to obtaining its consent in advance and in writing, and the site or mobile App should not be presented in a way that detracts in any way from the contents contained therein . You undertake to immediately notify the Company of any risk of harm to users or third parties or any existing or anticipated breach of the provisions of the law or these terms of use arising in connection with your actions .
Without derogating from other remedies provided to the Company by law, if you have violated the terms of this part or the Company has reasonable grounds to suspect that you violated the terms of this Section, the Company may freeze or cancel your account and refuse any current or future use of the Site, mobile App or the Service or any part thereof . In addition, you hereby declare and confirm that you know and agree that the Company will be entitled to take all the measures available to it by law against you, if you breach the terms of use as stated, including the transfer of your information to third parties . 

You may not copy, modify, lend, lend, sell, distribute, adapt, translate, reverse engineer, decompile or disassemble any portion of the service and/or device or create derivative works based on the Services (in whole or in part), or any of the MyLee information or resources of the service, MyLee systems and technology, and any other content related thereof (including contact information, video, text, logo’s, icons, images, data, documentation, or other IP as detailed above in any way  unless you are told that you can do so by the Company or the relevant Content Owner in a separate written agreement.  

9. Limitation of Liability

The company develops reference values and standardization for testing of breast milk. Today, there are no international standards for breast milk composition s and there are no customary reference values. The reference values, the presentation and the recommendations given by the Company are based on the research and development that the Company maintains and which is continuously evolving. Therefore, as the Company's development process progresses, global research activity in the Company's field may and may reserve the right to update the reference values and / or methods from time to time. Accordingly, custom recommendations may be updated and adjusted from time to time. In addition, the Company relies on the consumer use of the device and App, in accordance with our usage guidelines. The Company assumes that you acted in accordance with the exact instructions, but deviation from the guidelines may lead to deviation in the results to one side or the other. Finally, the Company does not undertake that the implementation of the recommendations that are given based on the analysis will cause any change to the desired or expected change. You therefore agree that you will not be entitled to any reimbursement of any payment or other compensation for any result or effect of the result on you or your baby.
YOU ACKNOWLEDGE AND AGREE THAT THE SITE, MOBILE APP AND THE SERVICES ARE PROVIDED TO YOU AS IS , AND YOU AGREE AND AGREE THAT THE MYMILK LABORATORIES LTD, INCLUDING ITS REPRESENTATIVES, EMPLOYEES, MANAGERS, SHAREHOLDERS AND EMPLOYEES, SHALL NOT BE LIABLE FOR ANY DAMAGE (DIRECT OR INDIRECT, CONSEQUENTIAL OR SPECIAL) YOU OR ANY THIRD PARTY IN CONNECTION WITH YOUR USE OF OR RELIANCE ON THE SITE, APP, DEVICE AND THE SERVICES, DIRECTLY OR INDIRECTLY, ON THE RESULTS OF THE SCAN OR PERSONAL RECOMMENDATIONS.
YOU AGREE AND CONFIRM THAT YOU WILL NOT HAVE ANY CLAIM, DEMAND OR CLAIM AGAINST THE COMPANY OR ANYONE ACTING ON ITS BEHALF AT THE CASE AGE OF ANY DAMAGE, INCLUDING DAMAGE CAUSED BY USE OF THE SERVICES AND INFORMATION OFFERED ON OR THROUGH THE MOBILE APPLICATION, THEIR ACCURACY, RELIABILITY, COMPLETENESS, UPDATING OR FREQUENCY OF INSIGHT PRESENTATIONPUBLICATION. THE USE AND RELIANCE ON THE INFORMATION ON THE APP AND PROVIDED IN THE FRAMEWORK OF THE SERVICES WILL BE AT YOUR SOLE AND FULL RESPONSIBILITY . YOU AGREE THAT FOR ANY MATTER ARISING OUT OF THE USE OF THE SERVICES, YOU ARE FULLY RESPONSIBLE FOR CONDUCTING ADDITIONAL TESTS AND RECEIVING APPROPRIATE PROFESSIONAL ADVICE, TO THE EXTENT THAT THE CIRCUMSTANCES SO REQUIRE, INCLUDING WITH RESPECT TO THE INFORMATION PROVIDED TO YOU BY US.
IN ANY CASE, THE COMPANY'S LIABILITY CEILING IS THE PRICE PAID FOR THE SERVICES.
The computer records of the site regarding the actions taken through the site will constitute prima facie evidence of the correctness of the actions. 

10. Indemnity

You hereby undertake to bear full responsibility for any breach of the Terms of Use and hereby undertake to indemnify the Company for any loss, loss of profit, payment or expense incurred by it, including attorney's fees and court costs in connection with the breach of these Terms of Use. 

11. Changes to the Terms of Service

The Company may change from time to time the terms of use of the Site. The mobile Application and the Services, including the Privacy Policy, forms, instructions that come with the assessment and warnings, without prior notice and without your explicit consent (except for a change in the Privacy Policy which requires explicit authorization by law). Any change to the Terms of Use will obligate you within 10 days from the date of publication of the revised Terms of Use on the Site.

The interpretation and enforcement of these Terms of Use and any derived thereof shall be construed in accordance with the laws of the State of Israel. The court authorized exclusively to deal with all matters relating to these general conditions shall be the competent court whose seat is in the District of Tel Aviv-Jaffa only. It is hereby clarified and agreed that the Company may assign, transfer the rights and obligations included in or arising from these Terms of Use, in whole or in part, including intellectual property rights of any kind, in any form to any third party, without prior notice or consent.

13. Disclaimer and Consent

The use of the Mylee system and the information provided on the App are at your own risk and in your sole discretion. In order for you to make a decision regarding the use of the system, services or product and to knowingly choose whether to use the product and offered services and to rely on the information provided to you, please read carefully what is stated in this disclaimer.
The registration to the App, the use of the MyLee device for scanning your milk sample, as well as the filling of the information and the use of the Mylee App constitute your consent to the contents of this document as well as to the use of the data.

       2. Base assumptions regarding the Mylee product and service

MyLee SYSTEM is a new development by MyMIlk Laboratories LTD, intended for early feedback on breastfeeding establishment and milk dynamics.  System includes hand held Breast milk SCANNER, for SENSING A TINY SAMPLE OF YOUR BREAST MILK and mobile App for recording SOME PERSONAL INFORMATION, and for generating personal insights. The Mylee system scanner and App developed in MyMilk laboratories, with the expertise of human milk analysis. However, it is important to know that there are currently no standards for the testing of levels of components in breast milk (for example, as opposed to blood or urine tests). An important component of the revolutionary and advanced service that MyMilk offers is the development of new testing processes, the creation of new processes or the integration of existing processes, as well as the development of standardization of results, the determination of reference values, database, algorithms, and the attribution of specific recommendations. The Company has invested and continues to invest considerable efforts and resources in the development of the procedures, algorithms, and validation of the reference values. However, it is important to remember that R & D is in progress and therefore there may be changes from time to time in the product, system, or in the manner in which the results or the reference values are analyzed.
In addition, the recommendations made on the basis of the milk results are determined by the professional-scientific team of the company, with great care for the accuracy of the information, based on findings reported in the high scientific literature and protocols and accepted by some professionals. These resources are subjected to changes, and MyMilk will act to update its recommendations accordingly. The field of research regarding breastfeeding, and breast milk is a constant process of development, and the Company is one of the leading companies in its field.
Mymilk does not undertake that even careful monitoring of the recommendations will necessarily lead to a change in mother's breastfeeding, baby care, breast care, mother’s milk supply or to any other expected change.
In addition, the services are intended for healthy nursing mothers between the ages of 20-45 for healthy singleton term infants aged 1-4 months. And  the research that underlies the services is aimed at mediating these. I. 

          3. Our basic assumptions regarding the use of the mylee system, general recommendations and qualifications

In the product kit and in your On-boarding email notification that will be sent to you (after completion of ordering) there are detailed instructions for the method of the use of the MyLee and App. In order to make use of the system and to provide you with as accurate results as possible, you must follow the instructions accurately.

MYLEE DEVICE IS NOT INTENDED FOR DIRECT TOUCH WITH THE MOTHER'S BREAST OR NIPPLE, AND ANY MILK SAMPLE THAT COME IN CONTACT WITH THE DEVICE PARTS IS DISMISSED.  DO NOT DIP THE DEVICE TO A FEEDING CONTAINER, KEEP CHILDREN AND INFANTS OUT OF REACH. In order to get reliable reads, it is critical to follow the instructions of use including the detailed guide of milk collection, performing a scan and parts washing and drying. Failure to comply with the instructions regarding the use of the Mylee device will affect the results and their validity. Therefore, the Company does not make any undertaking with respect to the results, the accuracy or accuracy of the results, and by using the system you agree that the Company shall not be responsible in any way for the results, the use it will make of the results, or the reliance on the results. The Company shall not be liable for any damage, direct or indirect, caused or may be caused to you or your baby as a result of the direct or indirect establishment of the system results or system recommendations.
MyMilk takes reasonable measures to make sure that the information on the App is correct and accurate as possible. However, there may be error or inaccuracy in the information or the way it is transmitted to you, and hereby you declare that you know this and hereby exempts MyMilk from any responsibility and liability in relation thereto. And you are not entitled to a refund for these errors. 

The system results, charts, recommendations, and insights are based on information provided by you via the App. You must provide real, accurate information as much as possible. Providing misinformation may result in bias in results, deviation from reference values, or misrepresentation of the results and/or the provided information or recommendations. 

The system reference value and algorithm are based on in-house generated database, and values are usually determined, unless otherwise stated, in a manner appropriate for healthy, term, breasted infants and may not be appropriate for your baby.
The system insights, tips, alarms and recommendations are based on the scan performed by you, and the information you provide via the App. Inaccurate scan performance or inaccurate information records, can damage the validity of the results and recommendations. 

THE RECOMMENDATIONS ARE BASED ON THE ASSUMPTION THAT THE MOTHER AND BABY ARE HEALTHY AND HAVE NO SPECIAL PHYSIOLOGICAL LIMITATIONS. THE RECOMMENDATIONS ARE FOR MOTHERS WHO ARE BREASTFEEDING A HEALTHY BABY BORN ON TIME. CURRENT VERSION, RESULT INTERPRETATION AND RECOMMENDATIONS ARE INTENDED TO MOTHER BREASTFEED A HEALTHY BABY BORN ON TIME, AND DO NOT SUPPORT PRETERM FEEDING OR MULTIPARA FEEDING. IN ANY CASE, IT IS IMPORTANT TO REMEMBER THAT THE PURPOSE OF THE RECOMMENDATIONS IS TO PROVIDE THE USER WITH TOOLS FOR GENERAL ASSESSMENT AND IS INFORMATIONAL ONLY, NOT INTENDED FOR DIAGNOSE OR TREATMENT OF ANY MEDICAL CONDITION. 

The results of the test in any case do not indicate the amount consumed or absorbed by the baby, or the adequacy of the milk, and does not indicate the health of the mother or the health of the baby. In no case are these results directly or indirectly directed to introduce or supplement baby formula, or to indicate how much milk is directly produced or consumed by the baby. It is our opinion that mother’s milk is the gold standard for infant nutrition unless otherwise instructed by a personal caregiver. It is highly advised to use Mylee App while in close contact with your lactation consultant or care provider.

 

The results and recommendations presented are general recommendations only. They are based on an algorithm and do not replace personal care recommendations that can only be given by a personal caregiver (lactation consultant, nurse, or doctor) after performing all the necessary personal examination, assessments and tests. It is your responsibility to consult with a lactation consultant or other caregiver if necessary, and not rely solely on the results presented and the general recommendations generated by the system. 

It is important to emphasize that acceptance of the general recommendations given along within the App does not indicate that no further actions or examinations are required to prevent complications or improve your breastfeeding, or yours or your baby's health. You understand that the general information provided to you is no way constitutes a substitute for your request for medical advice from lactation consultant or other personal care provider and you will have no claim or demand from Mymilk for the use you make of the recommendations.

        4. There is no substitute for medical advice on the App or services

YOU AGREE THAT THE INFORMATION ON THE MYLEE APP OR THE SERVICES IS NOT A “MEDICAL ADVICE” OR A SUBSTITUTE FOR SUCH ADVICE, GENERAL OR SPECIFIC, THAT TAKES INTO ACCOUNT THE SPECIFIC DATA AND NEEDS OF EACH CUSTOMER, AND DOES NOT CONSTITUTE A SUBSTITUTE FOR MEDICAL EXAMINATIONS. YOU AGREE THAT THE CONTENTS OF ANY PROFESSIONAL INFORMATION PROVIDED ON THE APP DO NOT CONSTITUTE ADVICE OR PROVIDE AN OPINION ON THE MATTER OR SUBSTITUTE FOR MEDICAL ADVICE OR OTHER PERSONAL TREATMENT (NURSE, NUTRITIONIST, LACTATION CONSULTANT OR OTHER PERSONAL CAREGIVER). IN ANY CASE WHERE THERE IS ANY SUSPECTED MEDICAL PROBLEM, WITH BREASTFEEDING, THE BABY OR THE MOTHER, THE USER’S SOLE RESPONSIBILITY IS TO CONSULT WITH A PERSONAL CAREGIVER IMMEDIATELY. IN ANY CASE, IT IS HIGHLY ADVISED TO USE MYLEE APP AND DEVICE WHILE IN CLOSE CONTACT WITH YOUR LACTATION CONSULTANT OR PROFESSIONAL CARE PROVIDER.

14. Obligations and consent

In order to enable us to provide the Services, you must undertake and declare as follows:

You are free to choose not to use the Mylee system. In order for the company to give you the service, you must declare the following. Your registration to the App or the use of the MyLee milk sensing device for assessing your milk sample, constitute your consent to the follows:

1. The Mylee system, INSTRUMENT AND SOFTWARE ARE NOT INTENDED FOR DIAGNOSIS OR TREATING ANY MEDICAL CONDITION in the mother or baby, and can be considered as a supportive information only, for promoting healthy lifestyle. Information learned through the site is not intended for the purposes of self-diagnosis, prevention or treatment of diseases, nor it intended to be a substitute for professional medical advice. You understand that while the system or the service provided by the company may suggest inadequacy or possible changes, this should be verified and supplemented with diagnosis and individual consultation with a qualified lactation consultant, nurse or a doctor. The company urges you to consult a lactation consultant, doctor or other healthcare provider if you have any questions or concerns regarding the MyLee results, our reports, or any issue. System is secondary to personal caregiver routine practice and advice. In any discrepancy between the system and the caregiver, follow your care giver advice. 

2. You confirm that You are willing to scan milk samples, voluntarily, knowingly and without compulsion, and give MyMIlk Laboratories LTD the permission to process the data arising from the scans. You confirm that you are aware that this information is of a personal and sensitive nature. You ask the Company to disclose this information to you and the others you have approved.

3. You confirm that by using the mymilk system you choose to disclose, voluntarily, knowingly and without compulsion, to MyMIlk Laboratories LTD, PERSONAL IDENTIFIERS (such as name, e-mail, ID) and Personal HEALTH INFORMATION (such as Dates,), milk parameters, and other information regarding your breastfeeding practice, baby and OB/GYN information. You are NOT obligated to disclose any of the information, any you can choose what information to include. This information is used by the system algorithm, and therefore you understand that the information provided affects the outcome. You understand that all of your non-identifiable, and identifiable information will be stored in the company's databases (in secure cloud based storage provided by third party service providers in the US, Europe and Israel) and will be processed in accordance with the company's privacy policy. The company assures you that unless otherwise approved directly by you, your personal identity will be kept confidential by all those involved and will not be published.

4. You understand that the use of the device and App is solely your responsibility. In order to make use of the system and to provide you with as accurate results as possible, you must follow the instructions accurately. Failure to comply with the instructions of use of the device, or providing misinformation via the App, may affect the results and their validity, and therefore the company should not be held responsible in any way for the results, or their use.

1. You warrant that you are not a company engaged in data collection or analysis, insurance company, private detective, employer or other entity trying to obtain information about  MyLee products or services through the use of MyMilk services.

2. You hereby confirm that you are not in contact with a company or other entity attempting to obtain information about the technologies or intellectual property of MyMilk Laboratories.

3. You take responsibility for all possible consequences of sharing your account, information recorded in the App or your scan results with others.

4. All proprietary rights - including without limitation the method, technology, software, sensor, reference values, algorithms, processes, and all know-how arising from the use of the MyLee device or the system belong to MyMilk Laboratories. You understand by using the MyLee device or providing additional information about yourself, you have no right to research or the intellectual property or commercial products developed or improved by the company, with the information you have provided. You will not receive any compensation or money for any research or commercial product that will include the results of the information from your milk scan or from information you have provided yourself to the App.

5. You hereby declare that you have the authority, under the laws of the country/state in which you live or receive the Service, to secure and maintain such representations and warranties. In the event of a breach, the Company has the right to freeze or terminate your account and refuse any or all of your current or future use of the Services. And you will indemnify the Company against any demand, cost or damage caused to it due to a breach of the representations and warranties above.

Finally, in order to continue the research in the scope of the Company and improve its tools, services offered to you and others, and other research and development purposes by MyMilk Laboratories you give your explicit and irrevocable consent to the company  to make use of the information collected at the system, in a de-identified manner (ANONYMOUSLY) and/or aggregated form (in a manner that does not identify you or violate your right to privacy). You will not be notified of any specific use. You understand that sample scanning, or providing information about yourself, does not entitle you rights to research or products developed by MyMilk. And you hereby grant the company an irrevocable license to utilize the de-identified personal information for any scientific, educational, marketing, and research and development use by the company. 

15. MyLee GPT CHATBOT USAGE

You may choose to use MyLee GPT CHATBOT SERVICE for informational purposes,  This smart chatbot is based on GPT assistant that has MyLee specific data and is trained to help you with any Q regarding the use of the device and App and support your breastfeeding journey. For this service MyMilk and its Chat/AI service providing will record, use, process and transmit the content and any information, including personal, that you write in the chatbot. Before using MyLee GPT Chatbot you must read and agree to the MyLee GPT Chatbot Disclaimer and Privacy notice, as detailed below,
