Company Privacy Policy and Disclosure

In order to use the Site and the Services, you must first familiarize yourself with and read the Privacy Policy set out below. You may not use the Site or the Services if you do not accept the Company's Privacy Policy as it appears on this page and as updated from time to time.Ā 

1. Collecting and receiving information

When you use the site or the mobile Application, information about you will be collected as a user of the record or as a non-registered user, such as products and services that you have been interested in or purchased, information or advertisements read on the site or mobile App, the pages or screens viewed, the means of payment used, the location of the device through which you accessed the site or mobile App, Internet Protocol ( IP ) address, the date and time of access to the site or mobile App; The web address of the website from which you directly accessed the site, etc. By using the Site or the mobile App, you acknowledge that you have read, understood, and agree to this Policy and any related Terms of Use. This information is intended to help improve the Site or mobile App experience, to analyze activity, to manage it optimally, to verify necessary information, and to protect data. The Company, including its employees or contractors, may at any time use the Site and its services and retain such information for monitoring and statistical analysis.

The Site uses cookies for its ongoing and proper operation, including to collect statistical data about the use of the Site, to verify details, in order to adapt the Site to your personal preferences and to information security needs. "Cookies" are text files that your browser creates according to a command from the company's computers. Some cookies will expire when you close your browser and others are stored on your computer's hard drive. The information in the cookies is encrypted, and the Company takes precautionary measures to ensure that the Company's computers can read and understand the information stored therein .
If you do not want to accept cookies, you can avoid this by changing the settings in your browser. To do this, please consult the browser help file. Note, however, that disabling the cookies may result in you being unable to use some of the services and features on the site or on other websites. In addition, you can delete the cookies on your computer at any time. It is suggested that you do so only if you are convinced that you do not want the site to be tailored to your preferences.Ā 

Details of the user you have provided, any additional information that may be collected about you in a manner that may personally identify you, such as your name and email, and other personal information including health information about your birth date, breastfeeding habit , baby information such as weights and your health OB/GyN submitted and the results of the milk scans if included within the Services ("Personal Information") will be stored in the Company's database. The Company takes a strict information security policy to maintain the confidentiality of its customers' information in accordance with the provisions of the law. Without derogating from the foregoing, MyMilk will take all reasonable measures in the industry to ensure that your personal information is kept confidential.Ā 

Except in the event that you wish to receive services as an authorized user, you do not have to give any personal information to Mymilk and service delivery will be done according to your desire to register for the service.
If you confirm this during the registration process (by clicking or checking in the appropriate place) or the order or during the use of the Site or Application, marketing and advertising information may be sent to you from time to time by e-mail. You may cancel this at any time by contacting us at contact@mymilklab.com.The Company will not forward your personal information to advertisers.Ā 

Our Services, or parts thereof, are hosted using data hosts (such as AMAZON AWS), which provide advanced security features. We employ industry standard security procedures, including secured transmission protocols, SSL and advanced authentication. However, we do not and cannot guarantee that unauthorized access will ever occur. We urge you to use the strongest password combination available on your mobile device and employ reasonable physical security means to protect unauthorized access.Use of the information received and collected

The use of personal information and other information about you will be done solely for the purposes set out below, subject to the provisions of any law:

  1. To provide you with various services, including product shipment and the creation of a personal account where you can receive and follow milk results and track provided data. Computerized recommendations, personalized recommendations and general recommendations will be displayed, as well as the purchase of products and services on the Site or mobile App.

  2. To improve and enrich various services and the content offered by MyMilk, in order to create new services that meet the requirements of the users of MyMIlk services and their expectations, and to modify or cancel existing services.

  3. To create an anonymous database of different habits and breast milk indicators. The database will be used for analysis, product improvements, control or research and development purposes. In addition, the Company may publish research using anonymous data or share anonymous and non-identifying information with non-profit organizations or commercial partners for research.For purposes of this Privacy Policy, we will treat any User Personal Information that is anonymized and deidentified in a way that such User can no longer be personally identified as Non-personal Information and may use or share this information in aggregated form for statistical, research or other lawful purposes.

  4. To match the ads you see when you visit the site to your interests. The information used by the Company for this purpose will not personally identify you by name, ID or address. However, this information, which does not personally identify you, may be transferred to third parties, including advertisers.

  5. To contact you through the Site or by email to provide the Services, accompany at various stages of the process as part of the Services or in addition to the Services or after termination of the Services for the dissemination of additional relevant information including advertising.


2. The right to review the information and request to change or delete

You are entitled to demand in writing that personal information will be corrected or deleted from the database, and you are entitled to request in writing that the company delete information in the Company's databases used for personal contact with you or personally identify you. The Company will delete the information it needs to contact you personally, as requested. Exercising such rights of deletion may result in our inability to provide you with our Services in an irreversible manner. Information required by the Company for the conduct of its business, such as documentation of personal and commercial activities you have performed on the Site, will continue to be maintained by the Company in accordance with law, but will no longer be used for your inquiries. 3. Sharing information

The Company does not publish or share your personal identifiable information without expressly requesting and receiving your prior permission except in the following cases: (1) it is required to do so by law. You agree that the Company may keep and disclose personal information to other statutory authorities and bodies if required to do so by law, court order or other authorized body by law or in good faith belief that such disclosure is reasonably required to (a) comply with the requirements of the (B) in order to enforce the Terms of Service (c) to respond to contentions that infringe the rights of third parties; (d) to enforce the Terms of Service, Protect the rights, property and personal security of the Company, its employees, contractors, users, customers and the public; or (e) Vera, that the disclosure of information is necessary to prevent serious damage to the body or body of a third party. In this case, the Company will notify you by email or the address you provided to the Site as part of the User's information, unless such notice violates any law or court order. THIRD PARTY SOFTWARE/SERVICE PROVIDERS.

We are partnering with several selected service providers, whose services and solutions complement, facilitate and enhance our own. Such Third Party Service Providers may have access to, or process on our behalf Personal and Health Information that we collect, hold, use, analyze, process and/or manage. These Service Providers include hosting, database, and server co-location services (e.g. Shopify and Amazon Web Services), data analytics services (e.g. Google Analytics), advertising and marketing services (e.g. Klaviyo, Meta and Google Ads), session replay records for app analytic purposes such as crashes, functionality and usability (e.g. UXCam), and our business, legal and financial advisors (collectively, "Third Party Service Providers"). We remain responsible for any Personal Information processing done by Third Party Service Providers on our behalf not in accordance with the terms hereof, except for events outside of its reasonable control and except for such Third Party Service Providers with whom you have a direct contractual relationship (e.g payment service providers, and FSA/HSA gateways e.g. withFlex).

UXCam: We may use UXCam, which is an analytics solution. UXCam may record: Screens visited, Interaction patterns (such as screen actions, gestures: taps, scrolls) and Device details (Type, Version, Model, Operating System). We are using the information collected by UXCam to improve our app. UXCam does not collect personally identifiable information and does not track your browsing habits across other apps. Payment service providers: financial information such as credit card or FSA/HSA information and the related personal and identifiable information that you provide in the scope of transactions through the services are processed by our 3rd party services providers and are used for verification, eligibility assessment and performing the financial transaction and may be obligatory for performing the financial transaction and is subject to the terms and conditions of each provider.

In some instances, we will enable you to share reports with your care provider. The MyLee apps allow you to directly share your identifiable personal information (report) with a chosen contact via your preferred communication method on your device. By choosing to share this identifiable personal information, you authorize the transfer and accept that the handling of this information thereafter is the sole responsibility of both you and the recipient. We recommend ensuring that your chosen contact has appropriate privacy and security measures in place before sharing.

This Privacy Policy is an integral part of the Terms of Use and will be read and considered as an integral part thereof.

Privacy Notice for California Residents

This Privacy Notice applies to Consumers residing in the State of California (hereinafter the "California Privacy Notice" or "Notice"), who are entitled to certain rights and protections with respect to their Personal Information under the California Consumer Privacy Act of 2018 (as amended by the California Privacy Rights Act of 2020) and the California Consumer Privacy Act Regulations enacted thereunder (the "CCPA").

The terms "personal information", "business purpose", "commercial purpose", "sale" and "service provider", "share" as used in this Notice have the meanings ascribed to them in the CCPA. Terms used but not defined in this Privacy Notice will have the meanings set out in theĀ Ā "Privacy Policy". If there is any conflict or inconsistency between the terms of this Notice and the Privacy Policy, the terms of this Notice will govern.

We fully describe our practices to all MyLee Users in our Privacy Policy, please review it for a fully detailed explanation of our practices.

1. Categories of Personal Information We Collect From California Consumers

We collect the following categories and types of personal information:

  • Personal Identifiers, such as name, email addresses, billing and shipping addresses, phone number.
  • Customer characteristics, which includes the categories of personal information described in the California Customer Records statute (California Civil Code Section 1798.80), including physical characteristics, medical information, payment information and characteristics of protected classifications under California law, such as gender and date of birth.
  • Personal Information you actively input when you use our Services such as account credentials, milk sample results, habits, emotional and mental state, breastfeeding confidence, as well as ongoing feedbacks that you provide us, information you enter in reviewes, our ā€œContact Usā€ online form, satisfaction survey or any similar input.
  • Personal Information transmitted in the course of using our Services such as descriptions of your physical/mental objective and/or subjective state and nutrition data, breastfeeding habits, weight, sleep habits, food, herbal teas and water intake, breastmilk maturation data as measured via use of the MyLee Device and through the MyLee App and derived analytics and insights.
  • Commercial information, including purchasing habits, such as adding items to your shopping cart, adding items to your saved items list etc.
  • Financial information, such as credit card or bank account numbers, that you provide us in the scope of transactions you make through the Services, which is processed by our third-party services providers and to which we have no access.
  • Internet or other electronic network activity information, such as IP address, UDID (Unique Device Identifier), browsing history and cookie history, and technical device information such as device type, app analytics, taps and inputs, device motion Wi-Fi network information, operating system, MyLee Device technical information, browser and keyboard language, the 'click-stream' and activities on the Services, and the period of time the Services were used and related timestamps.
  • Geolocation data.
  • Biometric and other sensitive personal information, such self-Reported Information about breastfeeding confidence, breastfeeding habits, physiological, behavioural, and biological characteristics, sleep, health and conditions.
  • Audio information, such as recorded customer services calls.
  • Inferences, which are drawn from the above information to create consumer profiles reflecting certain preferences and behaviors and customized content/offerings.
  • Personal information collected from other sources. We may also collect personal information about you from third parties who have represented to us that they have obtained your consent for such provision of information or that you have freely and publicly provided.
  • App usage information for the purpose of understanding user behavior, identifying and fixing bugs, and for improving the product for use.

In the 12 preceding months, we may have collected Personal Information from the following categories of sources:

  • Consumer directly.
  • Tracking technologies.
  • Third party applications and platforms (including social media) connected o your MyLee account with.

2. Business or Commercial Purpose for Collecting, Sharing and Selling Information

We collect and disclose your personal information for the following business and commercial purposes: to provide, operate and improve the Services; verify the identity of our Users;Ā  personalize the Services and content provided to you, to customize and improve your use experience of the Services, and to enable you to retrieve your information; to be able to contact Users for the purpose of providing them with technical assistance, support, handle requests and complaints and collect feedback; send you updates, notices, notifications, and additional communications regarding the Services; study and analyze the information on an aggregated, statistical basis to discover patterns and anomalies, to study complications and treatment methods and improvements, and other health related research and development; enable us to further develop, customize and improve the Services based on Users’ common preferences, uses, third party services, features and functionalities, statistical and research purposes, attributes and anonymized data etc.; prevent, detect, mitigate, and investigate fraud, security breaches or other potentially prohibited or illegal activities; display or send to you marketing and advertising material and general and personalized content and advertisement via the Services, the Website, email, postal mail, telephone, mobile devices and/or when you visit other sites; perform functions or services as otherwise described to you at the time of collection; and comply with any applicable rule or regulation, to protect our legal interests and/or respond to or defend against (actual or potential) legal proceedings against us or our affiliates.

Third parties to whom we disclose Personal Information for our business and commercial purposes include Third Party Service Providers, including hosting, database and server co-location services (e.g. AWS), data analytics services (e.g. Google Analytics), session replay records for app analytic purposes such as crashes, functionality and usability (e.g. UXcam), and our business, legal and financial advisors;ā€Ž health care providers, care management services or health care payersā€Ž.Ā 

We do not make your data publicly available; we do not act as data brokers, we do not trade in your data, and we do not Sell or "Share" your data (as this term is defined under the CCPA; i.e. for the purpose of cross-context behavioral advertising). Accordingly, we also do not knowingly sell or share personal information of users under the age of 16. We do not offer services to Minors. We do not disclose any sensitive personal information for any purposes other than the legitimate purposes set forth in the CCPA Regulations.

3. Your California Consumer Rights

California consumers have the right to request access to the specific pieces of personal information we have collected about them. You may make this request up to two times in a 12-month period.

You may also request additional details about our information practices, including what personal information we have collected about you, the categories of personal information we have collected about you, the categories of sources of such collection, the business or commercial purpose for collecting personal information, the categories of third parties to whom we disclosed your personal information, and the categories of personal information we have disclosed about you,Ā 

You also have the right to request the deletion of your personal information (subject to certain exceptions), to correct any inaccurate personal information we may have about you and to receive equal service and price and not be discriminated against even if you exercise any of your CCPA rights (unless permitted by applicable law, such as if the differences are reasonably related to your information).

California consumers may make a rights request by emailing us at contact@mylee.life . Your request must include sufficient information that allows us to reasonably verify you are the person about whom we collected personal information, which may include your email address, name and other account identifyers (which is required only if you already have an account with us). If you have an account with us, you can find your provided information in the settings > My profile section in the MyLee App.

4. Authorized Agents

You can use an authorized agent to make a request to exercise your California Consumer Rights on your behalf if:

  • The authorized agent is a natural person or a business entity; and.
  • You sign a written declaration that you authorize the authorized agent to act on your behalf. If you use an authorized agent to submit a request to exercise your right, please provide us with a certified copy of your written declaration authorizing the authorized agent to act on your behalf using the contact information below.

The request must:

  • Provide sufficient information to allow us to reasonably verify you are the person about whom we collected Personal Data or an authorized agent. We cannot respond to your request or provide you with Personal Data if we cannot verify your identity or authority to make the request and confirm the Personal Data relates to you; and
  • Describe your request with sufficient details to allow us to properly understand, evaluate, and respond to it.

We will only use Personal Data provided in a verifiable consumer request to verify the requestor's identity or authority to make the request. Making a verifiable consumer request does not require you to create an account with us.
